2. Service Description

USALEAD.com provides consumer contact data lists for lawful marketing, research, and business purposes. Our products consist of downloadable CSV files containing consumer contact information organized by U.S. state, including names, addresses, phone numbers, and demographic data points.

3. Lawful Use Only

You agree that all data purchased from USALEAD.com will be used exclusively for lawful purposes in compliance with all applicable federal, state, and local laws, including but not limited to:

  • Telephone Consumer Protection Act (TCPA): You must comply with all TCPA regulations regarding telephone solicitation, including prior express consent requirements for auto-dialed calls and pre-recorded messages to cell phones.
  • Telemarketing Sales Rule (TSR): You must comply with the FTC's Telemarketing Sales Rule, including time-of-day restrictions and required disclosures.
  • Do-Not-Call (DNC) Regulations: You must scrub your calling lists against the National Do-Not-Call Registry and applicable state DNC lists before making any telemarketing calls. While our data includes a DNC flag, it is your sole responsibility to verify DNC status before contact.
  • CAN-SPAM Act: If using data for email marketing, you must comply with all CAN-SPAM requirements.

  • Resale, redistribution, or sublicensing of the data to third parties without written consent
  • Any purpose that violates the privacy rights of individuals
  • Sending unsolicited communications in violation of applicable laws
  • Discrimination based on any protected class

5. Data Accuracy Disclaimer

While we strive to provide accurate and up-to-date information, USALEAD.com makes no warranties or guarantees regarding the accuracy, completeness, or currentness of the data. Consumer data changes frequently due to moves, phone number changes, and other factors. Data is provided "as is" without warranty of any kind, express or implied.

6. Licensing

Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the data for your internal business purposes. This license does not grant ownership of the data. You may not resell, sublicense, or redistribute the data without prior written authorization.

7. Payment Terms

All payments are processed through NOWPayments in cryptocurrency. Prices are displayed in USD and converted to your chosen cryptocurrency at the current exchange rate at the time of payment. All sales are final upon payment confirmation, subject to our Refund Policy.

8. Delivery

Upon successful payment confirmation, you will receive an immediate download link. Download links are valid for 72 hours with a maximum of 5 downloads. It is your responsibility to download and securely store your purchased data within this timeframe.

9. Limitation of Liability

To the maximum extent permitted by law, USALEAD.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or data, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless USALEAD.com, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use of the data, your violation of these Terms, or your violation of any applicable law or regulation.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of our services after any modifications constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration.
